Terms of Service (TOS)
Welcome to NotGhosty. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Candidate", or "Employer") and NotGhosty. By accessing our platform, submitting application telemetry, or utilizing our volatile zero-storage ATS scanner, you signify your unreserved assent to these Terms.
1. Platform Mission & Neutral Tool Architecture
NotGhosty operates as an interactive computer service providing neutral computational and algorithmic tools. Under 47 U.S.C. § 230(c)(1) and foundational jurisprudence in Kimzey v. Yelp! Inc. (9th Cir. 2016), our mathematical Credibility Score (Ci) is calculated through objective linear arithmetic applied to user-submitted telemetry and calendar recency. NotGhosty does not author qualitative subjective pejoratives and maintains zero editorial malice toward any business entity.
2. Candidate Telemetry & Proof-of-Application
Candidates voluntarily submit empirical hiring interaction data, including application timestamp confirmation, interview callbacks, explicit rejections, and unacknowledged ghost reports. Users warrant that all telemetry submitted represents truthful, first-hand experiences. Submission of fraudulent reviews, deceptive DKIM headers, or manufactured application receipts is strictly prohibited and grounds for immediate ban.
3. Guaranteed Free Employer Right-of-Reply
In accordance with the audi alteram partem doctrine and European Union Digital Services Act (Regulation (EU) 2022/2065) Articles 16 & 17, verified employers have an irrevocable, guaranteed free right-of-reply. Employer statements and evidentiary rebuttals are published co-located alongside candidate telemetry in equal visual prominence without payment of any fee. NotGhosty operates zero pay-to-remove or reputation extortion schemes.
4. 72-Hour Pre-Badge Notice Quarantine & Dispute Mediation
Any candidate telemetry aggregate that would trigger an adverse credibility transition (such as Disputed, Suspected Ghost, or High Risk) enters a mandatory 72-hour cooling-off dispute quarantine. Automated notification is transmitted to the verified employer domain contact, affording the organization opportunity to furnish ATS disposition webhooks or dispute invalid reports before public badge update.
5. Zero-Monetization Candidate Advocacy
To eliminate commercial conflicts of interest, NotGhosty decouples affiliate pay-per-click monetization links whenever an opening is flagged with degraded credibility. Traffic is silently rerouted directly to the employer's organic careers portal. NotGhosty never profits from unverified, stale, or ghost job postings.
6. Recruiter & Employer Requisition Standards
Recruiters and employers posting listings warrant that openings represent genuine, funded, and currently active hiring requisitions. Listing evergreen placeholders without intent to hire, soliciting candidate application fees, misclassifying employment status, or operating resume harvesting syndicates constitutes a material breach of these Terms resulting in immediate delisting and permanent domain blocking.
7. Disclaimers of Warranties & Limitation of Liability
The platform, services, ATS diagnostic tools, and credibility scores are provided strictly "AS IS" and "AS AVAILABLE". To the fullest extent permissible by applicable law, NotGhosty disclaims all warranties, express or implied. NotGhosty shall not be liable for any indirect, incidental, punitive, or consequential damages arising from reliance on statistical hiring scores, job availability, or candidate outreach outcomes.
8. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
